Innocent and Deported

I've got bad news to share. I wrote a couple of weeks ago about the case of cousins Julio Maldonado and Denis Calderon. Unfortunately, I came to the story too late. The day after I wrote, Maldonado was deported to Peru -- a country he left when he was three. He doesn't speak Spanish and found housing with distant relatives. He's stuck in a foreign land because of an injustice that started when he was jumped 13 years ago.

The Philadelphia City Paper has the sad story of Maldonado and Calderon, who is still detained in the U.S. and scheduled to be deported next year. The injustices suffered by these men never seem to end.

The cousins say they were wrongfully convicted of murder aggravated assault for a 1996 fight. They say they were the victims of a hate crime. They were involved in a scuffle after a group of white men began yelling racial epithets on a Philadelphia street and attacked them. Even prosecutors agree that the white men started the scuffle. Maldonado and Calderon then grabbed a steering-wheel lock and a baseball bat -- they say to defend themselves -- and critically injured a man who prosecutors say was an innocent bystander a man who prosecutors say was an innocent bystander ended up in a coma (he may have gone into a coma because of a pre-existing blood clotting condition, more below). The man died two years later. The white men were never charged.

And now the prosecutor who convicted them -- Seth Williams -- has been elected as Philadelphia's next attorney general.

The judge at their bench trial said Calderon and Maldonado had been justified in using force, but convicted them because they had allegedly beaten a bystander. They won an appeal when the judge learned that there was no trauma to the man who had died -- he apparently wasn't beaten. The judge at one point chided a prosecutor, saying: "I also remember these two individuals who had no records, going around the corner to get a beer and being attacked by these racists, you understand me?"

They never got their new trial, however, because their convictions were reinstated when prosecutors appealed the case. They served their sentences and moved onto the deportation conveyor belt. Maldonado's date came due on October 23 and he was deposited in Lima.

He says he will continue to fight, and hopes to come back to his adopted homeland soon:

"I just can't see myself staying away from the United States for so long," he says. "I think I had to go through all this so someone would finally notice there was an error somewhere down the road. The experts are the ones who need to resolve this, because the 'experts' were the ones who just kept making the case worse."

    For clarification, Philadelphia uses the term "District Attorney" not attorney general. And this is a very complicated case. Bennion's "full facts" are skewered in favor of the defendants and Bennion takes too many opinions as facts.

    There are 3 sides to every story; yours, mine, and the truth.

    Good evening Mr. Barr -

    Respecting your opinion... but I am curious to understand what makes you think this case wasn't about Hate & Injustice?

    Please, if you think anything we have stated is wrong or a lie or an opinion vs a fact, I will gladly address it.

    You see, while I wasn't at any of the trials, I have reviewed the transcripts enough times that I could probably recite specific quotes without much effort.

    I understand that from a fact perspective, they were convicted - but the fact also remains that Judge Smith vacated his own conviction because after hearing a "real" expert he realized Denis or Julio could not have hit the assailant, who was wrongfully labeled a 'victim'.

    Don't get me wrong - it is terrible what happened to him - but it wasn't due to any wrongdoing by Denis or Julio.

    Anyway... I only ask you this because there aren't too many people who are willing to discuss this - due to it's complexity, but your doubts and certainty on this intrigues me so I'd like to understand if it's founded.

    All I can say after reading Bennion's piece is that hearsay from either the plaintiff or defendant in a criminal matter does not constitute fact.

    Bennion said,

    "In 1996, Julio was visiting Denis at his home in Philadelphia when the two were victims of a racially-motivated attack by a group of white youths who insulted them with a racial slur.  When the cousins responded to the slur, the youths began throwing beer bottles at them.  The two cousins tried to escape, and then attempted to defend themselves.

    Julio ran to his car and pulled out a “Club” anti-theft device and wielded it against the person he saw stabbing Denis with a knife, 18-year-old Christian Saladino.  Part of the Club detached and flew off, striking a nearby car.  Unbalanced, Julio brought the remaining portion down and struck Christian’s shoulder.  Christian got up, took a few steps back, and collapsed.  He was taken to the hospital and revived but fell into a coma.

    Denis had run to his house where his wife called the police.  He grabbed a baseball bat and ran outside looking for Julio, who he believed was being attacked.  Denis did not see Julio, but swung the bat around his head to fend off his attackers, hitting no one.  The police soon arrived.

    When the police arrived, they arrested Denis and Julio.  They recovered two knives at the scene but did not test them for blood or fingerprints since no witness testified that Denis or Julio had used a knife.  Denis and Julio were charged with aggravated assault.  None of the white youths were ever charged with any crime."

    There seems to be a group of opinions stated and not clear facts. Bennion cited nothing in his piece to back up the statements he made about the crime from either perspective. Instead he wrote what he was told or read somewhere. I would like Dave Bennion to cite his sources rather than engage in a he said - she said diatribe putting the onus of guilt on those whom he wishes.

    Your website seems to do the same. We have one dead man and two perps who have been in the court system since 1996. The two are fortunate that they haven't been charged and convicted of murder. Just my opinion. But I do feel sorry for both families as neither the death nor the deportation will change anything in this world. Perhaps if your cousin would have run into his home and called 911 instead of getting weapons this would be a non issue today.

    I mean no ill will to you, your cousin, or Dave Bennion but the facts are just not clearly stated and appear to be opinions.

    Since I wasn't present at the scene of the crime nor present at the trials, I can only give my opinion based on what I've read.

    I wish you only the best of luck in helping your family overcome this hardship.
